TN Visa Professional’s I-140 Schedule A – Nurse Petition Approved.

The Petitioner in this case offered a permanent position for a Registered Nurse – Nursing Information System Specialist. The permanent position required the individual to train nursing staff on clinical documentation; provide clinical application support to the nursing staff and managers; perform quality control checks of clinical nursing computer systems; report nursing data to management; implement clinical application enhancements to nursing information systems and processes; and create communication materials for nursing departments.

Not a typical RN position, but we believed it would qualify as a RN under the Schedule A green card provisions based on favorable language from the Occupational Outlook Handbook, which stated that Nurse Informaticists are RNs who “manage and communicate nursing data and information to improve decision making by consumers, patients, nurses, and other health care providers.”

We filed this I-140 Immigrant Petition in October 2007. Because the beneficiary works in the U.S. under TN status, we selected immigrant visa processing on the I-140 petition to alleviate the immigrant intent issue. The Texas Service Center approved the I-140 this week.

Once an immigrant visa number becomes available under the EB-3 category, the beneficiary will complete the green card process at the U.S. consulate in Montreal.
