TN Visa Approval – Computer Systems Analyst with Biomedical Tech Degree
BACKGROUND:
The TN visa applicant, a citizen of Canada, was offered a job as a Business Analyst for a university where the applicant would be working with a system used to assess cancer in patients.
TN VISA CATEGORY:
JOB TITLE / DUTIES:
The position was responsible for performance measuring, testing, and quality control of the university’s imaging system used to assess cancer levels in patients.
To establish that the job offer fell within the TN visa category for Computer Systems Analysts, in my cover letter to USCBP I explained and evidenced how the position was consistent with the Occupational Outlook Handbook’s definition of a Computer Systems Analyst.
I also included further evidence showing that that Computer Systems Analysts go by a variety of job titles including Business Analyst.
EDUCATION:
The TN visa applicant possessed degrees in Biomedical Tech and Biochemistry. However, the applicant had not taken many computer-related courses.
Anytime an applicant does not have a degree in the applicable TN occupational category, U.S. immigration officials can question eligibility. Often, the lack of a degree in the field can be overcome by showing the completion of substantial coursework in the TN visa occupational field.
In this case, the applicant had not taken any computer courses during her degree programs (but had completed some training in computers after graduation). A different approach then was needed to show how the applicant qualified for TN visa status.
To establish how the applicant’s education was relevant to the position offered, I helped prepare an employer support letter that explained how the applicant’s degree in Biomedical Tech was relevant to the job because it involved working on a system that processed biomedical data.
To solidify the applicant’s qualifications, as part of my cover letter to USCBP, I referred to U.S. immigration memos, the Occupational Outlook Handbook entry for Computer Systems Analysts, and other career publications to confirm that a Computer Science degree was not required for a Computer Systems Analyst position, and that a Science degree could also be acceptable.
I also helped prepare letters evidencing the applicant’s prior experience performing job duties similar to the position offered.
