TN Visa Approved - Registered Nurse (Nurse Practitioner Job Title)

BACKGROUND:    

  • The applicant, a citizen of Canada, was offered a job as a Nurse Practitioner.

  • I reviewed the position offered, and although the job title did not exactly match the TN visa category for Registered Nurses, based on the position’s job duties and supporting research, I believed the position could be classified under the RN TN category.

JOB TITLE / DUTIES:    

  • As the Nurse Practitioner job title did not match exactly with the TN occupational job title, and because of prior questioning by USCBP over a Nurse Practitioner role’s eligibility for TN status, in my cover letter to USCBP I explained how Nurse Practitioners were a type of Registered Nurse. Additionally, I included extensive career and industry publications to support this claim.


EDUCATION:    

  • The applicant was licensed as a Registered Nurse and as a Nurse Practitioner by the State of New York.

  • She possessed a Master of Science Nurse Practitioner degree, and a Bachelor of Science degree in Nursing.

  • She was also certified as a Registered Nurse by the Commission on Graduates of Foreign Nursing Schools (CGFNS) - a requirement for certain health care workers to obtain TN visa status.


FILING PROCESS:    

  • TN visa status application applied at the U.S. Port-of-Entry in Buffalo, NY (Peace Bridge).


PROCESSING TIME:    

  • Approved same day as filed. 


APPROVAL PERIOD:  

  •  TN visa I-94 issued valid for 3 years.
