TN Visa Approval - Geographer; Manager Job Title

BACKGROUND:    

  • The applicant needed to renew her TN work authorization.

  • Even though the applicant had been working for the same employer in a similar role for several years, prior TN approvals do not guarantee future approvals.

  • USCBP officers often make it a point to tell applicants that they review each application as if filed for the first time.

  • In this position, the applicant was responsible for the project management of Geographic Information Systems (GIS) projects.

  • Because the applicant had a managerial job title, which often leads officers to contest TN eligibility, it was important (again) to explain how the position still qualified for TN status.

SOLUTION:    

  • Based on the duties involved, we argued that the applicant’s position fell within the Geographer TN occupational classification (as further defined in the OOH).

  • To establish that the applicant’s position qualified for TN status, we helped craft an employer support letter that full described the Geographer/GIS tasks involved in the position.

  • We also provided the applicant with a cover letter to USCBP, and supporting evidence from various career publications showing that Geographers work on GIS projects, and may have managerial job titles and functions.

  • The applicant possessed a degree in Geography, and as such, was a perfect match for the Geographer TN occupational classification.


FILING PROCESS:    

  • TN visa status application filed at the Buffalo, NY Peace Bridge USCBP office.


PROCESSING TIME:    

  • TN visa status approved the same day.
